Photography Services Terms and Conditions

1. Agreement to Terms

By booking a photography session with The Flash Mob Collective and it’s photographers ("Photographer"), you agree to the terms and conditions outlined herein. These terms are binding for both parties, the Client (you) and the Photographer.

2. Booking & Payment

  • Booking: Payment in full is required to confirm a booking.

  • Payment Methods: Payment is accepted via visa, PayPal or etransfer.

3. Cancellation & Rescheduling

  • Client Cancellation: If the Client cancels the booking less than 48 hours before the session, the payment will be forfeited. Cancellations made before 48 hours of the session will receive a full refund.

  • Rescheduling: The Client may reschedule the session at no charge to another available time slot.

  • Photographer Cancellation: In the rare event that the Photographer must cancel or reschedule, the Client will be notified as soon as possible. The Photographer will offer to reschedule or refund any payments made.

4. Session Details

  • Client Responsibilities: The Client agrees to arrive on time and be prepared for the session. The Photographer is not responsible for any delays or disruptions caused by the Client.

5. Deliverables

  • Edited Photos: The Photographer will provide the Client with high-resolution edited images, delivered via digital download.

  • Timeline for Delivery: Edited images will be delivered within a timely manner following the session, barring unforeseen circumstances.

  • Additional Photos: Any additional edited photos requested beyond the agreed-upon number will incur an additional charge.

6. Copyright and Usage Rights

  • Ownership: The Photographer retains the copyright to all images taken during the session.

  • Client Usage: The Client is granted a personal, non-exclusive license to use the photos for personal, personal promotion, non-commercial purposes (e.g., printing, sharing on social media, etc.).

  • Commercial Use: Any commercial use of the photos (e.g., for advertising, marketing, or merchandise) other than personal promotion requires prior written consent from the Photographer and may incur additional fees.

7. Model Release

The Client grants the Photographer permission to use any images from the session for portfolio, promotional, or commercial purposes. The Client can request that certain photos not be used for these purposes by notifying the Photographer in writing before or immediately following the session.

8. Liability and Indemnity

  • Photographer Liability: The Photographer is not liable for any injuries, accidents, or damages occurring during the session unless caused by the Photographer’s negligence.

  • Client Indemnity: The Client agrees to indemnify and hold the Photographer harmless from any claims, damages, or losses resulting from the Client’s actions or failure to follow safety instructions during the session.

9. Equipment & Technical Issues

While every effort will be made to provide high-quality images, the Photographer is not responsible for technical failures, equipment malfunction, or circumstances beyond their control that may affect the quality of the final images.

10. Privacy and Confidentiality

The Photographer will treat all Client information as confidential and will not disclose any personal details without prior consent, except as required by law.

11. Force Majeure

The Photographer is not liable for failure to perform their obligations if such failure is caused by circumstances beyond their control, including but not limited to natural disasters, illness, or any other event that prevents the Photographer from fulfilling the contract.

12. Governing Law

These terms and conditions are governed by the laws of Ontario. Any disputes arising from these terms will be resolved in the courts of Ontario.

13. Newsletter Opt-in

The Client’s email address will be added to the Photographer’s email list. The Client can opt out at any time.

14. Miscellaneous

  • These terms and conditions may be amended at any time by the Photographer, and such amendments will be communicated to the Client in writing.

  • By proceeding with the booking, the Client acknowledges they have read, understood, and agree to these terms and conditions.
